I filed bankruptcy in August of last year. I have a $30,000 loan, guarunteed with a family members CD that was not discharged in the bankruptcy. I am paying $400 per month on the loan, and it is current as are all of my other bills. I rent and do not own a home. I work and attend school, and am married. I need to secure the $30,000 loan in another way, and need to release the CD's back to the family member as soon as possible, or I need to repay the secured loan with funding from another source. Traditional bank loans do not seem to be an option at this point due to the bankruptcy. I need assistance in finding avenues to explore in order borrow $30,000. |

Your family member could try to withdraw the $30,000 CD. This is especially effective if the bank that holds their CD is not the same instituation that loaned you the money. Although this strategy would get the money back in your family member's hands, they still would be liable for your loan. You could ask your family member to pay off the loan with their CD and explain that they are liable for the loan. The loan is probably at a higher interest rate than the CD, therefore you could pay the loan off faster if the CD money was used to pay the loan, and then you make the $400 payment to your family member. |
