Need to know by Monday 12/13/04 of court case regarding judges
ordering clinical therapists to write evaluations without being paid
for it. Need to be able to review the cases.

btiofnc-ga,

I haven't found any cases that even come close to matching your
description.  It's actually hard to imagine a judge ordering a
professional evaluation without expecting the professional in question
to be paid for their services.

Can you elaborate a bit on the situation.  The more details you can
provide, the better the odds that we can find a relevant case for you.

Client was completing a preadjucation assessement. Went to court and
was given probation as a sentence.  Order was to contue in treatment
at BTI. Probation did not like that and when Judge rotated off bench
(here they rotate every 6 months) probation went to another Judge and
had ordered modified where client went to another provider. That
provider and probation is now stating that BTI shold be ordered to
wirite up the evaluation without being paid for such. There is no
record of BTI writing up assessments for clients in the preadjucation
phase without charging them for the time it takes to write up an
assessment.  BTI has done this in the past for clients who were
actively involved in treatment and already on probation. This was done
as part of training to familiarize officers with techingues and why
recommendations were based on. Officers decided that they did not need
this so it was stopped. This is what probation is stating gives cause
to having BTI be ordered to write up this evaluation without being
paid.

BTI is Behavioral Technologies a private counseling agency
specializing in the assessment and treatment of people convicted of
sexual offenses. I am the national public policy representative of NC
for the Association for the Treatment of Sexual Abusers (ATSA.com),
the state chapter president (NCATSA.com) and serve on the  ATSA
Education & Training committee. In all my years of being in this
field, I have never seen a case where probation states that a clnician
has to write up a report and not be paid for it or a judge even have a
hearing on it. Probation has attmepted in the past to try and dictate
what type of treatment interventions are to occurr, pull people out of
therapy sessions and talk to them when sessions were occurring, wear
weapons in group therapy settings. I dissassocited with them after
being told BTI had to be on the same page as them (they had told a
client I was writing a report to extend his probation, told another
client I would be writing a report to show he successfully completed
treatment when he had not (even the client confronted the officer in
this example )) and focused doing only assessments.
