Hi,

I know that in Ontario you have a regulations that says "Children's
aid societies are authorized under the Child and Family Services Act
to provide protection services for children up to 16."

I wonder if there are similar laws in Quebec about this? or maybe the
age differs? or different rules?

Appreciate your answer!

Hi alexukie,

Briefly, each province and territory has its own legislation for
providing protection of children, and Quebec's Youth Protection Act
protects children between 0 and 18 years of age. Quebec differs from
the other provinces because it is the only province that is not
governed by the Criminal Code of Canada regarding family law.

Youth Protection Act:
"The Youth Protection Act became effective in Québec in 1979. Its
purpose is to protect children younger than 18 when they live in
situations that jeopardize or may jeopardize their safety or
development. Section 38 of this Act defines children in trouble, such
as children that are abandoned, abused, exploited, victim of physical
or sexual abuse or with serious behavior problems both at home and in
school.
This Act makes youth protection a collective responsibility. Any
person convinced that a child has problems must report it to the Youth
Protection Director. This responsibility is especially that of
teachers, policemen and professionals who provide children with care
or any other form of assistance (Section 39)."

Quebec's The Youth Protection Act:
"It should be remembered that all citizens are required to contact the
Director of Youth Protection if they believe that the safety and
development of a child between 0 and 18 years of age has been
compromised."

You'll find a good overview of provincial policies on the Human
Resources and Skills Development Canada (HRSDC) website.

"This report, which reflects each jurisdiction's provisions, policies
and programs as of September 1, 2000, is based on existing policy and
legislation, supplemented by information provided by each
jurisdiction. It should be noted that actual practice may vary from
the principles stated in legislation and policy. The report is an
information document only; no analysis of the material is provided."

I hope this helps. If you have any questions, please post a
clarification request *before* closing/rating my answer and I'll be
happy to reply.

Thank you,
hummer
