Here are the details: H1B 6 years expiring on 04/01/06. (May get 3.5 months of vacation recapture) EB3 RIR Filed on Mar 24th 2005 by Employer A 7th year H1B extension filed by Employer A on 01/03/2006 Quit Employer A 02/01/2006 H1B transfer filed by Employer B on 02/02/2006 based on pending Labor 7th year H1B extension filed by Employer B on 02/12/2006 Havent received the exact expiry date of 7th year H1B visa. Now, when its time to file for 8th year extension, what are the chances of getting the 8th year extension, if a) Start PERM process in Company B ASAP and then file I-140 before end of 7th year. b) Dont do anything and then keep extending H1B based on the pending Labor. c) Labor gets approved for Employer A and it gets substituted for someone else? Can someone give all the options that are feasible with respect to the above case? |
