In California, can the owner of a motel use the value of room and board provided to resident manager as a credit in determining the minimum wage paid to the resident manager. Example: The motel owner provides an on-site apartment for a resident manager who lives in the apartment full time. The manager works from 7:00pm to 7:00am spending most of the time in the apartment. Minimum wage would require wages of $81.00 ($6.75 X 12 hours). Assuming the reasonable value of the apartment is $30.00 per day. Can the $30.00 per day serve as a credit against the wages of $81.00? |

This is the IWC order which covers motels. section 10(C) Meals or lodging may not be credited against the minimum wage without a voluntary written agreement between the employer and the employee. When credit for meals or lodging is used to meet part of the employer's minimum wage obligation, the amounts so credited may not be more than the following: Apartment-two-thirds (2/3) of the ordinary rental value, and in no event more $381.20 per month Also if you are not "exempt" it would apear that you have some overtime coming (1 1/2x your hourly rate over 8 in a day, 2x for anything over 12 hrs in a day.
