I have a small company on the side. It is go cart racing in Ohio. I do it for a hobby and for fun and charity. We give things away. I move about $25,000 a year through this charity group. I thought that my accountant/lawyer took care of filing a 501(c)(7) charitable exemption form that took care of my taxes four years ago. However, I just found out that was not the case. Nothing was ever filed for this organization. My question is: 1) What can I do to fix this? 2) What type of penalty or penalties am I facing? Thanks, Lou |

Hi Lou, Check with Ohio laws. If the state laws are anything like IRS's, you are note required to file if the charity's income is under $25,000. If it's over that...well, you should be filing. Get it done quickly. Enclose an explanation about why it's late. And you won't have a problem. Keep waiting, and you're apt to lose your non-profit status - and all those kind donors will lose their charitable deductions. Best wishes Your TaxMama-ga |
