Hi indego,

Briefly, your girlfriend will need a regular visa to visit you, but if
she would like to work, she will need to apply for a Temporary
Residence Permit.

South African Department of Home Affairs: South African Visa:
http://home-affairs.pwv.gov.za/service_detail.asp?id=101

1. Do I need to provide a letter of invitation and to whom should it be addressed.

A "statement and/or documentation confirming purpose and duration of
visit" and "proof of financial means" are required to be attached to
the visa application. A statement from you confirming your invitation
and intention of financial support should be given to your girlfriend
for the application. It should be addressed to the First Secretary
(Admin + Consular) - D K Watermeyer in Denmark.

"The period of residence in the RSA will be determined from the
applicant?s date of admission to the Republic in accordance with any

3. Would it be possible for her to get a work permit while she is in
South Africa if she found a job.

She can only work if she applies for a Temporary Residence Permit
before she arrives. If you two decide to commit to each other for
life, she will be able to apply for a Work Permit from within South
Africa.

Applicants must also ensure that they apply for the correct visa
(transit or visitor's) or temporary residence permit reflecting the
true purpose of the visit, as any changes in the purpose of stay will
only be approved in the RSA for good cause and if the requirements of
the Act are complied with."
"Any applicant allowed entry into South Africa due to any
misrepresentation, or false declaration on the application form or who
sojourns in the Republic in contravention of his/her visa/permit
conditions shall be guilty of an offence and liable on conviction to a
fine or to imprisonment as an illegal foreigner."

What are the Requirements for a General Work Permit.
May a foreigner who is the spouse/life partner of a South African
citizen/permanent residence holder apply for a work permit... from
within the Republic?
May I extend my visitor's permit whilst in South Africa? Yes, you may.
http://home-affairs.pwv.gov.za/documents/faq_tr.pdf

Where to apply for a temporary residence permit:
"In terms of current legislation a foreigner may only change his/her
status whilst inside South Africa. This implies that a foreigner may
only change from a temporary residence permit to a permanent residence
permit within the country, as status has been defined as temporary or
permanent residence. Any foreigner who therefore wishes to enter the
RSA must apply for the appropriate temporary residence permit at the
South African diplomatic representative in his/her country of origin.
If the Department has no representative in that country the foreigner
must apply at the South African diplomatic representative in a
neighbouring or nearest country. The outcome must be awaited outside
and arrangements to proceed to the Republic must only be made once the
permit, as applied for, has been issued by the Department. Since
applications for temporary residence permits are processed and
finalised at the South African foreign offices the processing period
will be reduced considerably. "

Hi Hummer
Thanks for your in depth answers to my questions however I do have 2
things that I need clarity on.
a:In you answer to question 2. What is the maximum time ......... I
have the impression from your answer that there is no defined time to
stay in SA as a visitor and it would be solely as the discression of
the embassy involved. Is this correct?
b: Can you define life partner. I know this was not part of my
original question and if you decline to answer I fully understand and
will make it the subject of another question

Hi Indego,

a:In you answer to question 2. What is the maximum time ......... I
have the impression from your answer that there is no defined time to
stay in SA as a visitor and it would be solely as the discression of
the embassy involved. Is this correct?

It's funny you should ask that because I found myself thinking about
it when I woke up this morning.

When I researched your question, I did try to find a specific maximum
stay but I'm confident one doesn't exist for the following reasons. 1)
The length of stay that is requested on the application must be
matched with sufficient funds to cover the stay. Therefore, it is sort
of self-adjusting the way they have it set up. The longer your
girlfriend wants to stay, the more financial resources you will need
to prove. 2) She will always be able to apply for an extension as long
as she does so at least 30 days before her visa expires.

b: Can you define life partner. I know this was not part of my
original question and if you decline to answer I fully understand and
will make it the subject of another question

Life partnership (spouse) would be a conjugal relationship with
cohabitation and mutual financial and emotional support. You will need
an affidavit and "notarial contract" to support this claim.

?"'spouse' means a person who is party to a marriage, or a customary
union, or to a permanent homosexual or heterosexual relationship which
calls for cohabitation and mutual financial and emotional support, and
is proven by a prescribed affidavit substantiated by a notarial
contract and ??spousal relationship?? has a corresponding meaning;"
http://www.acts.co.za/immigration/1_definitions_and_interpretation.htm

Life Partnership Affidavit
"A life partnership affidavit is a document that both partners sign in
front of a Commissioner of Oaths, swearing that they are partners in a
relationship, and briefly stating what type of relationship they have
entered. Such an affidavit is often considered proof considered proof
of existence of the relationship, just as marriage certificate is
proof of marriage."

In regards to working, please see the following section (sorry, I'm
unable to copy & paste this document):

May a foreigner change his/her status (purpose) of entry from within
South Africa if he/she initailly entered for a visit and then receives
an offer of employment? Yes.
