Hi,

If two individualts wanted to register a trademark with the United
States Patent and Trademark Office, but wanted to limit to a certain
extent what the second joint owner may do with a mark, how can this be
done?

For example, one owner would use the mark in normal day to day
business. This owner would like to extend the trademark to a colleague
so the colleague may be free to use the mark in a limited way.

For example, the colleague could be experienced in law, and could file
a lawsuit against a third party to protect the mark.

What is the common practice for making an agreement? Is it possible
for the Trademark Office, when issuing the mark to the second owner,
to state on the registration that the use is limited to (listed
terms). If an agreement is made, does it have to be filed aith the
Trademark office?

This should be a pretty straightforward answer... I hope!

Got my answer on another pay-for-answer service. For the benefit of

Any joint-owners can have a "Terms of Use Agreement" which can define
the parameters of usage between the owners.
