Here is a scenerio to sum up my question.  
A person, lets say Joe, leaves a voicemail message for "Charlie".
Can Charlie transcribe that voicemail and use it against Joe without
telling Joe he is doing it.  This activity is done in the state of
Ohio.

Here are the details
Joe was employed at company XX and took a job with company TT. 
Charlie is employed at company XX during the same time as Joe. 
Charlie and Joe exchanged voicemails about information (all above
board) on company TT. Charlie is still employed at XX. However Joe
makes a comment about his new company on Charlie's voicemail.  Charlie
takes the voicemail, transcribes it, and sends it to Joe's company. 
Joe then gets fired from his job.
Answer  
There is no answer at this time.

Are you just going to transcribe it, not do anything more with it?
