We bought our current house in 2002 in Tampa, FL. It was covered under
a termite protection plan, originally with Sears and the Sears termite
protection plans were bought out by Terminix in 1997.

We received a letter from Terminix in 2002 saying"Don't Risk losing
your Terminix Termite Plan... as a Terminix customer" asking for the
annual renewal fee. We paid the fee and again in 2003 and 2004 with
the curent contract period ending 7/31/05.

Now they sent a Terminix man to say they are cancelling the contracts
of all "Sears" contract customers unless we pay Terminix $800 + and
sign a new contract with Terminix by October 2005. There is no mention
in their letter sent to us "as a Terminix customer" in 2002 that teh
Sears customers were under a 10 year contract, nor any reference to
such a clause.

Question: Does Terminix have the legal right to terminate our termite
protection plan based on a 10 year clause in a contract never
mentioned to us when we bought the house nor in the only written
contract of renewal they sent us?

I have the same problem.  My Atlanta home has been under Sears
contract since 1990, and I am presented with two options, both of
which ends the Sears liability and "starts the clock ticking" in 2005.
 HELP!!!
