Apparently in the Bahamas, there is a law (Chap 106) which says that a person under age 18 can get married with the consent of a parent or guardian. I want to find out exactly what the word "guardian" means in that context. In the US, it would mean a legal guardian, but are there are cases or sources of information which define what or who is a guardian under Bahamian law for the purpose of allowing someone to secure consent to marry when they are under 18. |

Guardian means the one responsible for the inor legaly. For example if the actuall parents can no longer take care of there child for what ever reasons. The child as a minor would then be moved into custody of eaither the state or a indavidual. And who ever they would move the custody into would be the legal guardian. In example if the parents give there legal parental rights to the grandparents then the grandparents are now considered the legal guardian. |

Thanks for your reply. i know the general concept, I am a lawyer myself. My question though was specific to Bahamanian law. Do you have any particular specific knowledge about Chapter 106 or know of a provision in their law. I am told that under Ch 106, it is not limit to family or even to a legally appointed guardian. |

From what I can find for the Bahama law is the consent of a guardian would be a person appointed by a court to be a guardian of a person. If either party is a minor (a person under the age of 18 years), parental consent is required.
