how do you file a lawsuit against some one who enters into a verbal
agreement, accepts several agreed upon payment schedules agreed upon
prior, checks so indicate what payments are representative of: and the
party calls you after this process has been honored and randomly says
the deal is off I want more money........this breach of agreement
thought berbal was satisfied originally and payments were well in
advance and paid ahead of schedule......the checks were cashed by the
other party.... their breach of agreement is to be viscious amd
maliscious in nature.... how do i bring suit against this pary for
breach, tort or otherwise.....

Which jurisdiction (country and/or state or province) are you in?  Is
the other party in the same jurisdiction?  How big are your losses as
a result of this breach of contract?

this agreement was to settle a debt in regards to a divorce. We
finally agreed to the terms of $100.00/month from myself to my ex. I
began the payment schedule we both agreed on by paying one month and
one month in advance to show good faith, She cashed the check and 2
weeks later said she was not going to honor her agreement , she wants
more. She plays this power game on and off for years. We finally make
a successful agreement and I follow it to the letter, she takes the
first 2 installments agrees, she even meets to get the payment....and
2 week later she says no to the agreement. It is is Massachusetts,
Merrimack County.  I feel whereas she agreed, even camre and received
2 payments, cashed the checks, I was there in my pary 100% now she is
in total non agreement, it seems to me she has willfully deceived, or
some sort of breach oir tort...???? I am not sure but in the end it is
a total breach to me.please advise.........thank you.
