My home (rented) was condemned by a Residential Inspector for the Department of Neighborhood Resources (Tucson, Arizona) soley because there was no electricity hooked up. I was given zero notice and told I had to vacate the premises immediately. I was also told it would be illegal to hook up to a gasoline operated electrical generator. Was this inspector operating according to law? The home is fit to inhabit in all other aspects, including water, sewer, and natural gas hookups. Do I have any recourse? |

After reading the Tucson, Arizona home page (www.cityoftucson.org/dnr) it shows that they are acting within the law. Every residence most have electricity and sewer services. Arizona State DNR does talk about the "Grandfather Clause" but without knowing your history I can?t answer that. As for hooking up and external source I again refer to the Arizona State DNR page that allows a construction permit to be issued for construction only. There is no mention of powering a residence with a gasoline operated electrical generator on permanent bases. However I am sure that your state?s DNR would not allow this. http://www.ci.tucson.az.us/dnr/Guide.pdf does have the number to your city officials. You can always contact them and file a grievance if you feel you have been done wrong. |
