I met a girl in India. She came to Canada to live with me but we never got legally married in either India or Canada. We broke up after a few months and I never saw her again. A week ago I got served with divorce papers. It appears she lied to immigration saying that she had gotten married to me in India. She did this in order to stay in Canada. So now she is on record with immigration Canada as being married and for whatever reason she wants to get that status changed. So she actually was gutzy enough to try and file an uncontested divorce. I think she thought I would never know but of course those guys who serve court papers are very good at finding people. Anyways, I need to talk to someone in Immigration about this to find out what the hell is going on. I talked to 3 lawyers the first was totally perplexed and couldn't help me. The second was totally perplexed but said for $2000.00 he would look into it. The third guy suggested I try and get a hold of immigration Canada. I have tried and tried to get a real voice on the phone but all I get is recorded messages from every immigration office I call. I need to talk to real person in immigration Canada about this matter and I'm running out of time. Kevin Williams |

Kevin.... I work in fraud investigations but not with Immigration Canada. I'm a bit perplexed. How could she file for a divorce without showing proof of marriage? Its my understanding that, at the time of filling out the paper work for a divorce, verification of the marriage must be submitted. As well, I can't see Immigration Canada documenting her status as "married" without concrete verification. I don't know how to contact a "live" person there, but if you do, have them check for marriage records with the Registrar General's Office in Thunder Bay. Something isn't right here. Steph53 |

I know something is definitely funny. If you?ve ever been to India you know anything can be bought for a price. I?m suspecting that she had some phoney marriage certificate fabricated in India and sent to her here is Canada. But I won?t know for sure until I can get a hold of someone in Immigration. |

I've tried that number already. All you get is their automated telephone system. You do have the option if you have a rotary phone to stay on the line but guess what??? When it tries to forward your call the line is always busy. And when I say always I mean I've been calling that number for 3 days about every half hour during business hours and not once have I been able to talk to a real live person. |

Hi again.... On the uncontested "divorce" papers, is there a name of a lawyer or a paralegal?? If not, the name of the court where the papers were filed should at least be there. Go in person to that courthouse and find out what evidence she used to show the two of you were married. In the meantime, I will check for a legit number to immigration that allows the public to access. I have one but its a private contact that I cannot divulge to the general public. Steph53 |

Why not just; 1) write a letter to immigration Canada explaining the situation and; respond to the divorce action by submitting a notarized statement that you were never married to the person bringing the action and explaining the circumstances. |

Quite. As daniel2d pointed out, you need to start a paper trail. Write a letter Enclose photocopies of all correspondence A notarized affadavit is a good idea - preferrably send them a small bound file with a brief covering letter KEEP COPIES OF EVERYTHING And send by some form of registered/recorded delivery. Add some form of receipt - include an SAE If possible communicate /only/ on paper - people can deny a 'phone call took place Synopsis. - create a folder of documents and send it to C.I. You want to get your stuff into their scanning system - and to get back acknowlegement(s) that it has been received. One more thing, if you lied to get her into the country, then admit it now. |

Steph, quick question... How much (Seattle, WA) prison time can a person reasonably expect for embezzling $30-40K from their employer in 1 year? Any idea of a ball park? A customer at the bar has been verrrry bad. Just curious. |

Hi Cynthia... I can't give you even a ballpark figure as I live and work in Ontario, Canada and the U.S. laws differ so greatly from Canadian ones. Canada is much more "lenient" with incarcerations, sentencing, etc. ( much to my dismay )Sorry......wish I could help more :( Steph 53 |

Kevin, I am from India. It could be possible that she may have made fraud marriage papers in India. In India, it is very easy to get fraud documents ranging from your birth certificate to your death certificate. So, it may be that she is showing that both of you got married in India, and now is filing for divorce. |
