Does any body knows how to write a motion to a Federal Court asking
for permission to travel outside the United States while I am in
probation
this will be a bussines trip as part of my job.for two weeks only.

I found a fantastic web site that describes how to write motions in
detail. I can provide the web site, along with some general advice for
the $5.00 you have offered.

I'm not an attorney so I don't write motions every day. I have written
about 4 (if memory serves me), but that was 20 years ago. If you would
like me to write your motion, I'd have to read all the instructions,
taking considerable time, and I would decline for the $5.00 offered.

You could read the web page I found, and I could write the middle for
you, where you have to say what you want, why, etc, fairly quickly,
but still too much time.

Keep in mind that you will need PROOF from your employer that this
travel is indeed work related, and --it is common for no travel to be
allowed for at least 30/60/90 days depending on the offense, and the
state and county in which the offense and conviction occured.

Also, --have you kept all your probation appointments? Clean UA's?, Do
you think you will get an approving 'nod' from your probation officer?
 I suspect not, otherwise s/he would have given you more
information...

When is the travel? The wheels of the justice system more Very Slow...

You are good! I have no problem with the parole officer in any respect,however 
he does not like the idea of me traveling outside the U.S. But he said is up 
to the court to decide that, I was planing to travel in September, I  like to 
take the webside you have now and any advise you can give me, maybe I can do it
myself, or I will get back to you and let you do it for me,let me know how we 
can stay in touch. Thank You.
PS. Sure,I have a letter from my boss explaining all about this trip.

Thanks for the reply, I have to work tonight --I get off at 2am so I
sleep late on Sunday.  I have a prior commitment, but I also have
Monday off and don't have to work until Tuesday at 7pm, plenty of time
to Answer.

Thanks for your reply,I wii be waiting for your answer,I just want to write
a simple motion pro-sec to the judge,and I think sometimes the judge apreciate
that better.

Hi elnino123!

I am happy to say I think you will find this link perfect!  It has
simple, easy to understand instructions and following that, are sample
forms for you to copy the format and spacing of your own Motion. If
you choose to "fill inthe blanks" you  will need to modify your choice
of form because they are worded with plantiff/defendant syntax. You
are simply Motioning the court. You would want to use a phrase such
as:

MOTION TO ALLOW WORK-RELATED INTERNATIONAL TRAVEL

Be sure to include the following:

1) Notorized letter from your employer. Must be complete with contact
information. Bring your boss to the hearing if s/he's agreeable and
supportive.

2) Your travel plans. Show round trip tickets, or an itineary if
possible. Bring the originals and have copies ready to give to the
court.

3) A statement from your Probation Officer recounting your perfect
reporting and compliance history. Get whatever support crumbs your
Probation Officer will  agree to. In all likelyhood your P.O. will
make a negative recomendation, in spite of your compliance, but the
court expects that.

If you could find the Rule Number that allows international travel to
be approved, and include it in the area stating WHY you feel you are
entitled to have the Motion granted, that would be good. Your P.O. has
that Rule Number, or can look it up quickly.

For what it's worth, I would select this form:

AFFIDAVIT/AFFIRMATION IN SUPPORT OF MOTION - pages 4 & 5 of the
document I linked above. It's very simple and straight forward.  Be
sure to Notorize the Motion!

Do you have probation officer?  Even if you don't contact the
probation office and ask them.

The probation officer said that I have to file a motion to the court
I can not afford a lawyer, that is why I am looking for someone that knows
how to write a motion to the judge. elnino123
