About 5-10 years ago in NYC there was an interesting case where the prosecutor requested that a defenant extend the life of the grand jury but the defendant refused to. The prosecutor thretend to bring an immedeate indictment if the defendant didn't capitulate, saying stuff like "we've already got enough on you to put you away", but the defendant knew he was inocent and basically said "if you got *any* evidence, then bring the indictment already." It turned that the prosecutor didn't have a shread of eviendce at all, so the grand jury did not hand down an indictment and was dissmissed. The case is interesting becuase, when faced with the threat of certain idictment now or possible indictment later, defendants always agree to extend the grand jury term. I *think* the prosecutor was Guiani and it was a federal case, but am not sure. What was the defndant's name or any details of the case? thanks, josh |
