I recently got a defered judgement on an OWI  in Iowa.  I will not be
sentenced until September.  I am moving to Autin Texas the end of
July.  My license is suspended in Iowa (by the DMV, not the court) for
180 days.  Texas law is 90 days.  Will I be able to get a license in
Texas after 90 days or even before if they don't know about it?

Dear bjcoolguy-ga;

The answer to your question is NO. You will NOT be able to get a Texas
license as long as your Iowa license is suspended (for whatever
reason). You see, both Texas and Iowa are member states of the Driver
License Compact (DLC) and the Non Resident Violator Compact. What are
these two compacts? Well?the DRIVER LICENSE COMPACT (DLC) is an
agreement between states that basically says you have only ONE
driver?s license record. Meaning, if you violate the law in one state
it goes on your record (and stays) with whatever license you hold.

The NON-RESIDENT VIOLATOR COMPACT (NRVC) is an agreement between
states to communicate with one another (i.e. pass along violation and
suspension information) if you get a ticket out of your home state you
are adjudicated for that violation (whether it results in a fine,
suspension, revocation, etc).

As for one state not ?finding out? what the other state has done ?
that?s not likely; especially between two states that voluntarily
share such information. Both Texas and Iowa share data over a
nationwide system called the National Crime Information Center (NCIC).
The status of your driver license will immediately be entered into
this database regardless of how the suspension came into being. You
may also be interested to know that I am a certified NCIC technician
and have held my certification for 20-something years, so I have quite
a bit of first-hand knowledge about this system and various states?
policies when it comes to drivers? records. Having said that, I can
assure you that there won?t be anything in the way of traffic history
from Iowa that Texas won?t know about.

Is it possible to get a temporary work-permit style licnese in Texas
in the mean time?

That is probably a question that can be answered for you at the Texas
DMV or perhaps even some legal representative in the state of Texas. I
do know that Texas does have such a provision but whether or not YOU
can get one is not something I can answer. This attorney however
suggests that he can "almost always" get a person a temp license
(whether he can or not remains to be seen). If he can get one for
someone who has a DWI then there's no telling what he might be able to
do fo you:

"Depending on your criminal and driving record, we can almost always
get you an Occupational Driver's License that will allow you to drive
to and from work. It will also allow you to drive between locations,
if your job requires you to travel as part of your duties."
