Hello,

Few months ago, my relative who stayed in my home for few months was
admitted to a hospital on emergency condition.  At the hospital, after
the treatment, he gave them my soc. Security number, but with
incorrect spelling of my first name and wrong year of my date of
birth.  He also signed my signature very similar to mine.  He did that
because he did not have Soc. Sec. number and legal immigration status.
 Later he migrated to Canada and he is there now.  He told me all this
after he left my place.  The bill came about $4000 and I was not
getting the bill until it got reached to collection agencies, because
they did not have my apt. # in my address they had.  Now three
collection agencies are giving me hell time to pay the amount -- $550,
$530 and $2960 respectively.  And I am in no way able to pay these
amounts.   So far, they have not reported it to the credit bureau.  I
am really nonplussed as to whether I should pay it so that I might not
suffer for sever years to have it removed.  I plan to buy a house in
the near future.  Even-though I don?t want to pay it and I can?t
afford it, it may be worthwhile paying it than face difficulty as the
result of its consequence.  If they may not report it to the bureau, I
don?t want to pay it indeed.  Should I pay it or better to fight it up
with the credit bureau when they (collection agencies) reported it
sometime soon?  I told collection agencies the situation and that I am
willing to pay it even-though it is not mine, just to have is closed,
but they refuse to accept monthly payments that I suggested ($100 each
agency per month).  The $2960 collection agency demanded that I pay
$715 initial payment and $150 monthly.  We did not agree.  I don't
suppose to pay it indeed, just afraid of my credit history from being
messed up.  Please advise, what would you have me do?

Hi Samadu,

You say he told you that he did this after he left your home?

Am I correct then in assuming that he did this without your knowledge or consent?

This is straight-up identity theft, regardless if it was done by a
friend or not.  I would suggest telling your friend that if he doesn't
find a way to pay the outstanding balances owed within a certain
timeframe (like within a week), that you are going to file a police
report for identity theft and list him as the one responsible for
illegally using your personal information.

You might as well go ahead and file the police report anyway, because
this is what the credit agencies are going to require as a first step
as proof to start clearing your name.  Do a search on any search
engine using the phrase "identity theft" in quotation marks and you
should find many websites offering tips on what you can start doing to
protect yourself.

Deadbeat is probably not going to be able to repay you unless he has
started working somewhere else, and you may need to sue him in small
claims court in Canada to get a judgement against him.
