Is it legal for an IBC (international business corporation) in St.
Kitts/Nevis to do business online (servers need not be in St.
Kitts/Nevis) that distributes pornography? |

Could you give us some more detail on the nature of the business? You
say distribute...do you mean through a website such as viewing
pictures and video clips, or selling adult materials such as toys and
videos? What type of pornography, soft or XXX?
The more details you give us, the better we can help you.

It would be a standard run-of-the-mill adult site. XXX of course, but
no underage, no animals, nothing of that sort. It would be
video/images/etc, no shipping of physical merchandise. However, credit
card payments would most
likely be deposited into a St. Kitts/Nevis bank account.
I have been trying to find the laws pertaining to possession of pornography
on St. Kitts/Nevis, but can't seem to find anything. And I'm not sure
if those local laws would even apply to an IBC incorporated in St. Kitts/Nevis,
but doing business online with servers in another country.

Mr. G.
You're quite right...there's not a lot of information available on the
specific laws pertaining to an IBC with servers out of the country.
I have found the following bits and pieces though:
--St Kitts promotes itself as an ideal place to establish internet
gaming operations, so I imagine they might not necessarily balk at an
adult site either.
--Oddly, the gaming sites are welcome, but they can't offer services
to local residents of St Kitts, since gambling is not legal on the
island. I imagine a similar situation might be the case for X-rated
materials. Regardless of what the local laws happen to be, they can
be readily accomodated by not accepting locals as customers, if the
situation calls for it.
--I have found an online directory of lawyers and other services in St
Kitts that can help establish a business there. Your best bet might
be to contact one of these firms to find out, directly, the status of
the laws pertaining to adult sites.
--I've also found a fair number of government contacts with the job of
promoting new businesses in St Kitts; they might also be able to offer
assistance.
I'd be glad to make these contacts on your behalf, if you think that
would be an acceptable answer to your question. However, I could not
guarantee what sort of information I'd receive, or whether it would
clearly address your particular situation.
On the other hand, I'd be glad to post the contacts as an answer, if
you think that would meet your needs (and you're certainly welcome to
adjust the price of the question, if you feel that is appropriate).
Let me know what you think.

I'll give it a few more days to see if anyone can get a definitive answer. If
nothing comes of it, I'll accept your list of contacts as an answer.. I'll
let you know when.
I'm trying to reduce the cost of contacting IBC lawyers until I know
what offshore country I'd like to use.. otherwise, I'd contact them ASAP.

Dear Mrgodzilla-ga:
I managed to run across a post form a resident of St. Kitts who said:
?I live in the Caribbean, specifically the island of St. Kitts and i
can [tell] you there is not a sex trade in the islands. I'm definitely
sure about the Eastern Caribbean, b/c that's the region i live
in?Furthermore, not every island in the Caribbean is a tourist whore
like Aruba. There are no brothels, whore houses, and pornography is
illegal in St. Kitts - it follows old British laws.?
