Question ID: 556957
My license was revoked about 4 years ago for my second DUI. About a
year and a half ago I received a restricted license. With the
following restrictions:

1) Must have Alcohol Interlock on any car I operate for 1 year.
2) May only drive between the hours of 6am and 9pm.

When I was given these restrictions I was told I could take the
Interlock off after 1 year, then the only restriction would be the
6am-9pm. I was also told I could petition in 1 year to remove 6am-9pm
restriction.

So, 1 year later I petitioned for a new license. I took my three
letters of recommendation, AA sign-in sheets and a final report from
the Interlock company.

The officer didn't like 2 of my letters as is and requested that I
send her edited letters or new ones. I faxed these to her. Also,
durin gthe interview she asked wheter or not I would continue to go to
AA and I told her no. I realize this was stupid but I was being
honest. I havent drank or gotten in any trouble since the second DUI.

Well about a month later I received a letter in the mail with my new restrictions:

1) Must have Alcohol Interlock on any car I operate Indefinately
2) May only drive between the hours of 6am and 9pm.

In the letter she stated that I only gave her two letters and my
knowledge of alcoholism was shaky.

Now for my question.

Since my restriction was only the 6am-9pm can the hearing officer
tighten the restrictions even though I havent been in any trouble? Is
there any possibility to appeal the ruling, since I cant repetition
for another year? If an appeal is possible lawyer referrals would be
appriciated.

It seems I would have been better off without ever having petitioned
the second time around.
