In English Civil Law, are the two parties to a case allowed to contact one another once a trial date has been set? I ask because the other party in the case keeps sending me letters which I find distressing and harassment. This relates to individuals. Please do not reply with answers which apply to committees or parliamentary protocols. Thank you for any help. |

uk police officer- there is no reason why 2 parties cannot contact each other unless it is forbidden by the conditions of the case. if this occurs the judge/magistrate will have set conditions to which either party will have to abide eg restraining order or conditional bail. if this is the case one or both parties will have been required to sign or been served with papers outlining conditions. alternatives- under the harassment act 1997, if a person commits an act or acts which cause harrassment alarm or distress on 2 or more occasions there may be liable to prosecution under the act. certain conditions apply- the person must know or ought to know their behaviour will cause harassment,alarm or distress. the sending of letters may constitute harassment. however if the other party sending letters does not know their conduct is causing harassment they wont be guilty. in other words you need to have told them to stop and they continue same behaviour. police will usually warn a person officially under the act to stop the harassment or they may be arrested. a statement will need to have been given to police. this may be an alternative approach to add weight to your case, and this may end in a criminal court not a civil one. |
