I live in Albuquerque, NM and I got a speeding ticket on 08/07/05. The
officer locked me with Laser at 50 MPH in a 35 MPH zone. The officer
that wrote me a ticket was not holding the laser gun. I didn't even
notice the officers on the side of the street until I was passing them
because the road was curved. I slowed down, and made a u-turn and
drove back to where the officers were. I'm looking for advice on how
to handle this as the officer did not even give me the opportunity to
take the penalty assessment. Now I have to pay court fees along with
the penatly. He said that I had to show up for court
for the ticket since I had to go downtown anyways for the proof of
insurance.  The ticket says he locked me at 50 in a 35 at 3264, which
I assume is how far I was from the gun.

I'm looking for specific advice on how New Mexico law and speeding
tickets. I've heard from several people that I should pospone the
court date to try and make sure the officer doesn't show up. Does the
officer have to be present in order for me to be considered guilty? Do
I have a fighting chance at avoiding the penatlies associated with the
ticket? Again, I'm looking for information directly related to New
Mexico. My court date is 08/26/05.
