Question ID: 561393
I am a holder of an H1-B Visa for more than 8 years (I keep renewing
it as I have an ongoing green card process pending)and I am going to
change jobs. I have a green card process going on and I already
received the labor certification approval (Form ETA 9089). I
understand the next steps are:
approval of the I-140(Petition for Immigrant Worker),
then approval of the I-485 (Application to Register Permanent
Residence or Adjust Status).
My current H1-B Visa expires in jan 2006.

QUESTION REGARDING VISA AND GREEN CARD IMPLICATIONS UPON CHANGING JOBS.
1- changing employee now will result in CANCELLATION of what I
received so far, basically I would need to re-start the PERM process
all over again?
2- I understand I need to switch the H1-B sponsor WHILE still employed
from the current sposnor?
3-How can I renew my H1-B visa (expiring in jan 2006) Do I need to
wait for my new employee to start a new PERM proccess so I can go to
my country and renew my visa?

Basically I need information about the steps I need to do in order to
change jobs. Follow important info:

- CURRENTLY UNDER PERM PROCESS
- LABOR CERTIFICATION (ETA 9089)APPROVED
- H1B HOLDER. EXPIRATION JAN 2006
- ABLE TO RENEW H1B BECAUSE I HAVE GREEN CARD PROCESS ON

I want to change jobs, continue green card process with news sponsor
and I want to renew my H1B.

THANKS

Hi Hummer, As I said I did not fill the I 485 application as of yet.

The only completed step is the Labor certification -> ETA 9089 which I
received in 60 days through PERM system.
