As a one-person employer that took on an employee for a short time, I
have been assessed a sizable penalty by the New York State Workers
Compensation Board and need to challenge it. I responded using the
form they initially sent, but they dismissed it. Where do I go from
here?

Your question seems simple enough but it's actually quite complicated.
The answer depends on a variety of factors including (but not limited
to) the type of claim made, the type of hearing held, the kind of
notice your recieved, the kind of form you filled out and returned and
what you may or may not have indicated on that form, just to name a
few.

You really need someone who is knowledgeable about such things in
order to get the right information. As an answer to your question I'd
be delighted to direct you to a VERY reputible organization in your
area whose sole purpose is to help employers in your position - small
business owners asking for assistance in handling issues they have
been unable to resolve through their own means. Would this be
acceptable as an answer?

Thank you very much. I realize the points you mentioned are very
pertinent, but I was specifically interested in publicly available
information on the web, regarding standard procedures. What kind of
entity are you interested in recommending? Is it a law firm? And what,
if any, is your relationship with the entity? How do you know it is
good?

The organization I would recommend is a liasion entitity that was
designed specifically for this purpose.

Absolutely not. It is not a law firm nor is it a "for profit" agency.
Its purpose is to help business owners through the Workers
Compensation process and the miseries that can sometimes go with it.

Rest assured that I have ABSOLUTELY NO RELATIONSHIP with this
organization and will not be ipacted by your decision to utilize them
or not. In fact, I live some 2000 miles from New York and have no
business interests in that state whatsoever. I am merely a researcher
who has done his homework.

The organization was created by state legislation in response to
businesses' requests to have one place they can call to get answers to
their workers' compensation questions and help with understanding the
workers' compensation system. Furthermore, the organization works
closely with the Governor's staff, the Legislature, the State
Insurance Fund, the New York Compensation Insurance Rating Board and
the Governor's Office of Regulatory Reform in your state to assist
their constituents with various workers' compensation related problems
they may have.

Short of consulting an attorney in exchange for what might prove to be
an exorbitent fee, this organization is by all accounts "THE" self
help resource for answers to Workers Compsation questions.

According to my research THE ADVOCATE FOR BUSINESS office is by far
(short of a paid attorney of course) the best place (and probably the
most economical place, since it is a public service) for you to turn
to for answers to your difficult questions. Here are some excerpts
that explain what the organization does:

York's business community and the Workers' Compensation Board. The
office was created by legislation as a response to businesses' request
to have one place they can call to get answers to their workers'
compensation questions and help with understanding the workers'
compensation system.

The major functions of the Advocate for Business office are:
 
To assist individual businesses with problems they may have with their
coverage, understanding their experience modification and
classifications, and with complying with the workers' compensation
law;

To educate business owners, government personnel on the way the
workers' compensation system works and the role that each participant
in the system plays; and

To meet with business associations and groups to listen to the
concerns they have regarding workers' compensation and report to
Chairman David P. Wehner those concerns and offer possible solutions
to address the issues.?


The Advocate for Business says that it has helped more than 200
businesses of all sizes ? from very small to very large - per month
with their inquires about the Workers Compensation system. They go on
to say that they have helped businesses save hundreds and sometimes
thousands of dollars just by assisting them through this complicated
process.
