I bought an automobile from an individual on April 27, 2005. He told me that it did have a lien on it and that with the money I gave him he would pay it off. I received the bill of sale from him, but as of today August 31, 2005 I still haven't received the title. I go to his house every week to see if it's come. He says no, it's on it's way. Of course, by now I know he has lied to me. What do I need to do in order to get something done about this. I have tried numerous times to get some help, but haven't had any luck. Please help me if you can. |

You need to file suit immediately. Perhaps you can have a police officer meet you at the person's house to demand the title to show him that you are serious. If the cost of the car was low enough ($5K or less in many places) you can file in small claims court and do not need a lawyer. However, even if you win your case, you might have a very tough time getting your money back or getting the title. Many people who win in small claims court are never able to actually collect the judgement. |
