Question ID: 564711
I went to the apartment of a guy I was seeing in Manhattan. While I
was waiting outside his apartment, he asked me to wait for him to
clean the apartment and then took me out for lunch. Then he called the
police. Two police officers came. One went inside his apartment. One
kept an eye on me and didn't let me go inside the apartment. The guy
talked to the police officer for about twenty minutes. The police
officer went out, gave me two summons. One harrass summon, the other
trespass summon. The summons asked me to show up in October, but I am
not a US citizen, I am a tourist. I needed to leave New York before
October. So I went to the 346 Broadway criminal court and ask them
what I should do with the summons. They asked me to send a letter to
the judge to explain the situation. So I did. What will the judge do
after receiving my letter? What is the maximum fine for harass and
trespass? Is this civil violations or criminal violation?

Besides, I am very curious. The police did not ask me any questions.
They just listened to this guy and did hear my story. They did not
arrest me. But they told me I could have been arrested and that if I
were arrested, I can never go into the country again. My another
question is, what if one day a guy set me up again, asking me to go
inside his apt, then call the police, and then this time the police
arrest me? Will I just get arrested and never being allowed to go into
the USA? This doesn't make any sense. I can not go into USA again
because the police give me a summon for violation I never commit?

I have a typo. I meant that police officers did NOT hear my side of
story and only hear his side of story. Besides, I was very curious
whether there is a woman inside his apartment that's why the police
officers and this guy purposely kept me outside his apartment - and
that is also a motive of this guy to call and lie to the police
officers and result in the summons. else, why would this person just
told me to call him two days ago, and then all of a sudden call
police?

another clarification. there are no my signatures at the buttom of the
summons. will this make the summons invalid? but i already send a copy
of the summons to the judge.

another question is how to counter-sue this person for lying to police
and getting me into trouble, and what will be the charge i can sue
him?

Here's an idea. Stay away from this guy. If he asks you back, don't
go. I doubt he'll ask you back, though.

If you totally innocent as you imply , then you should immediately
contact the embassey/consulate of the country of which you are a
citizen. (or if need be the country that represents the interests of
the country of which you are a citizen)

They should help you with the necessary legal aid to prove your innocense.

what about the letter I sent to the judge? I already sent a letter to
the judge explaining I will leave before specified date on summons for
court appearance. What will the judge do? Even if the judge will
dismiss the summons, will the judge send me a letter to say he dismiss
the summons? or I will not hear anything?

You need to get legal advice. You should not have written the letter
to the judge. The best way to get legal advice as a foreigner in the
US is to CONTACT YOUR EMBASSY immediately.

Why are you reluctant to do this? Is there something else you are not revealing?

also writing a letter to the judge is what the clert in the 346

resolved by paying a fine or something before i left USA.
