Who makes bad mp3's, and how do they do it?

If you've ever tried downloading a backup copy of a popular hit single
that you like, you often get an mp3 that is either corrupt, completely
blank, mixed with psychotic skipping/chirping, or something entirely
different. And I wonder, who goes through the trouble to create and
distribute these?
