Can you tell me if employers are required to get written permission
from job applicants when they do a criminal background check?

Most states protect this information somewhat.

As a police officer I found it difficult to get what we call yellow
sheets or rap sheets for people. Access to database version of these
files is somewhat more lax, as a an officer can access it armed with
only a case number. It is still not as easy as running a plate, which
is public information.

So it stands to reason that private individuals such as non
governmental employers would have to at least get your permission if
they were to seek this information legally. There are however illegal
ways to get at it.

Most employers, will have you sign a release of some sorts before
employing you, the release states that you are giving them permission
to access this sinformation, some employers even run your credit
score, to see if you pay your bills. So read anything you sign
carefully.
