Last month MBNA called my home and asked to speak to me.  However I
was not home so the baby siter gave MBNA my wifes work number for them
to call.  MBNA called my wife and proceded to share with her
information about transactions on my account...asking her to verify
the transactions.  The issue I have is that my wife is not on my
account.  The representative did not even ask for any kind of
verification.  I contacted MBNA about this and they said sorry that it
is not there policy to give out financial info and that they made a
mistake.  My question is what kind of legal action can I take against
MBNA.  They created a very big issue by divulging personal information
to an un authorized person on my account.

Actually, I've had a similar situation.  My roommate's bank, which is
also the bank I use, called.  When I said she was unavailable, they
asked if I were hubby.  I said no, she's not married and there is,
obviously, no husband on the account.  When I requested an explanation
as to why they wanted to speak to someone not on the account, they
said that they speak to spouses as all the accounts are considered
joint accounts (or something to that effect).  I should note that we
live in N.Y., which is not a community property state.

You might want to check out the Fair Debt Collections Practices Act to
get the actual regulations governing MBNA. See
http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm.
I'm not a lawyer, just own a collection-type agency, but having dealt
with lawyers a bunch I can say that to get a lawyer to take the case
you need to think about the actual damages you sustained and if it's
worth it. Otherwise, you might want to propose something to MBNA to
"settle", such as elimination of some of the debt. I don't know if
that would work, but it might and it may seem fair to all concerned.

Maybe just transfer your balance to another company to stop giving
MBNA your business?
