Right now I?m on H1B visa, suppose my employer lay off me then what will be the status of H1B visa 1. Can I stay in USA until getting new employer? 2. Suppose my prime employer lay off me and cancel my H1B visa, can I still look new employer staying in USA. 3. If prime employer cancels my visa, can it be transferable to other employer after even cancellation? Thanks, John |

I believe you have 10 days to find another employer to sponser your H1B visa. If you do not find another employer that will sponsor your visa then you will have to leave the US. This was my understanding of the law about 4 years ago. I am not a lawyer and the law might have changed in the meantime. But this fact was held over the head of some of my coworkers about 4 years ago. The employer beat them over the head with it and used it as an "incentive" method. |

Thanks for your effort. I mean, I was looking for an exact correct answer, your answer reflects uncertainty and I believe google provides answer after a lot research. If your answer is based on your past experience which happened 4 yrs back then it will be obsolete because everyday count. I hope there will some site or something where we can find exact answer and this is what customer expects from google?s special service. Thanks,John |

There is no written rule specifically stating that if laid off from H1b job, you need to find another job immediately. But there is a law clearly stating that if you exceed the visa stay period 1) by 180 days but less than 360 days, you'd be banned from entering the US for 3 yrs 2) if you exceed by 360 days, you'd be banned for 10 years. Many of my friends have been laid from work and found another in a few months. Though I believe recently INS asks for most recent paystubs when applying for H1B transfer. |
