My father has approx. $40,000 in credit card debt. He is dying and is not able to make his payments. Does this credit card debt die with him? He is a resident of New York State , if that is relevant |

"What happens to your credit card debt after you die? When you die, and there are no assets in the estate, the debts die with you as long as no one else held those credit cards." Credit card debt is unsecured, so as long as no one else is an authorized user of the cards, only the estate's assets are required to cover them. When my ex-wife died several years ago, my kids were concerned what her large credit card debt meant to a rather small estate. The credit card company decided just to write it off. Sometimes costs of collecting are greater than the money realized. Of course, do not count on this, since they do have the right to hit the estate for the money legally. This is a business decision of the individual credit card companies. |
