Dear Sir/Madame:
I am trying to find out if there exists any mandatory security
policies and/or procedures for food processors (in this case peanut
shelling facilities) in order to ensure the "integrity" of the food
supply under federal law and the associated agency regulations, i.e.
as published in the Code of Federal Regulations. The question breaks
down into three subparts -
1) The "Warehouse Act" - I have been told that peanut shelling
facilities are required to adhere to certain security policies as per
the warehouse act. The only warehouse act I have been able to locate
is the U.S. Warehouse Act under Title 7 of the United States Code. In
addition, the Warehouse Act is administered through the Department of
Agriculture - specifically through the Farm Service Agency. I have
found nothing in the statute or CFR that REQUIRES food processors to
engage in certain procedures for food security purposes. The only
thing I have come across are SUGGESTED food security plans issued
under directives by the FSIS - Food Safety and Inspection Service
which is also part of the USDA. These are located at www.usda.gov.
2) The "Bioterrorism Act" - same as the warehouse act. I have been
unable to find any "bioterrorism act." I did find, however, the
"Bioterrorism Bill", a.k.a. the Public Health and Bioterrorism
Preparedness and Response Act of 2002, which also contains the
Agricultural Bioterrorism Act of 2002. The citation is to the United
States Statutes at Large 116 Stat. 594. They are codified in Titles 7
(Agriculture) and 42 (Public Health and Welfare) of the US Code. 7
USC section 8401 and 42 USC 241 I believe.

Again, as with the warehouse act above, I have found nothing in the
statutes of the Code of Federal Regulations which MANDATES that food
processors (not talking about the USDA itself) undertake certain
procedures to protect against bioterrorism.
3) Finally I have been told that under the Commodity Credit
Corporation Act same thing - specifically CCC-22 requires certain
security procedures. Again - I'm not finding anything regarding

So I'm curious to see if you can find anything that contradicts my
