My husband's ex-wife keeps sending him messages and poems, saying that
he should go back to her. Is there any law against flirting with a
married man? Can we stop/punish her? We live in Maryland.

Dear antonia_slvdr-ga;

Thank you for allowing me to answer your question. What I can provide
you with is ?published law? and not legal advice (note that our
disclaimer says we cannot provide legal advice ? see your attorney for
that.)

With that aside, there is no Maryland statute that specifically
prohibits a woman from ?flirting? with a married man, but there are
some statutes that are designed to protect individuals (regardless of
who they are) from harassment (from anyone else, regardless of who
they are):

For example, there is a Maryland Statute that prohibits harassing
communications. If the messages are being sent via electronic mail
(e-mail) section § 3-805 applies:

MARYLAND CODE § 3-805
http://mgasearch.state.md.us/search97cgi/s97is.dll?action=View&VdkVgwKey=d%3A%5C2006%5Fstatute%5Foutput%5Cgcr%5CCriminal+Law%5F3%2D805%2Ehtm&DocOffset=13&DocsFound=20&QueryZip=harassing&Collection=fake1&Collection=fake2&Collection=2006+Statutes&SortOrder=desc&ViewTemplate=docview%2Ehts&SearchUrl=http%3A%2F%2Fmgasearch%2Estate%2Emd%2Eus%2Fsearch97cgi%2Fs97is%2Edll%3Faction%3DFilterSearch%26QueryZip

In addition there are a number of statutes that prohibit harassment in general:

MARYLAND CODE § 3-803

In Maryland any citizen may seek a variety of injunctions against
another to preserve the peace and ensure their safety. You can read
more about these types of injunctions here:

TUNRAROUND
http://www.turnaroundinc.org/pages/legal/laws.html

You might also check the divorce decree (or check with your husband?s
attorney) to see if the court imposed an injunction to protect your
husband from such harassment. If so the ex-wife may be in violation of
this order:

MARYLAND CODE § 1-203

You can find a good deal of legal information on this web site about

Looks like she did her research before acting - by not sending personal e-mails.

Thanks for your answers! Both the law section and the Turnaround
website were useful.

I have realised I did not explain the case very well. The way she
sends him the poems is by posting them on her website, which means no
harrassment laws can be used against her. The advice the turnaround
people gave me is just that we should stop reading whatever she posts,
but there's no law applicable to the case. :-(
