Hi, I applied together with my wife 5 years ago for permanent resident (GC), using I-485 form. I am Cuban and my wife is Mexican. I have been granted the GC since 18 months ago and currently in the process of obtaining the american citizenship. She applied for GC based on the fact I am cuban and there is an adjustment law for cubans. If I become american citizen and my wife has not still got the GC. Does she have to apply again now using I-130 ? What are the pros and cons ? Is it better for her to continue the process using the original I485 ? Is that possible ? Thanks, Ralph |

The I-130 is usually the fastest route to Permanet Resident status, but you can only apply after you have been sworn in as a US citizen. It also depends on where your wife is in the processing queue. If she is close to the end of the I-485 (Adjustment of Status) process, then it is best to stick with that. I would suggest that you call the USCIS helpline (1-800-375-5283). Just make sure that you have both your A number (it's printed on your GC) and your wife's number (should be in her passport) when you call. They will be able to advise you as to the best course of action. |
