I live on a college campus in DeKalb Illinois. Last weekend we threw a Halloween party that had at a max of 30 people at any given time. This morning we received a letter from our leasing office stating that we were being fined $50 for having more then 10 people in our apartment and $350 for having 2 kegs ($175). The party we threw had only cans of beer being served, but there was an empty keg form a long time ago that we used as a stool behind the bar in the basement. I don?t deny that we had more then 10 people in our apartment and would be more then happy to pay that portion of the fine. But I do not understand how they can charge us for having two kegs when we did not? (technically we did have one keg, but that was from along time ago and had been empty for months). I know in the lease it does state that that you can not have more then 10 people in the apartment and that kegs are not allowed, but what rights as a tenet do we have? What kind of proof should the leasing company have to prove that we were in violation? Since we did not have 2 kegs as the letter states, I know that they do not have any. Should they have to provide pictures or something to prove we had kegs/more then ten people? Also the party took place in the basement of a three story apt and was not viewable from the outside. Someone from the leasing company must have entered onto our property unannounced or invited to check it out. Is it legal for them to enter our apartment without giving prior notification ? without there being an emergency? I tried contacting the leasing department, but they would not even talk to me about the issue. I know I?ve asked a lot of questions and you all can not provide legal advice. I?m mostly interested in laws regarding the leasing company entering our property undercover in order gain intelligence. Thanks! |

My View not legal, would be first your lease will take center stage as to what fines you may be liable for, as you stated no more then 10 people at one time, and then next to the fine there should be a fine amount for violation, so pay the fine for the ten people, On the Keg, what does the lease say is the fine for a keg ? Now the he said she said, if they say two kegs and you say yes one keg but its furniture vs keg used for beer, then pay the fine for the ten people, but also send letter denying the two kegs ask for proof, if when you pay the rent they try an deduct the fine for the keg out of the rent first then state you are short on rent thus late fees send certifiec letter protesting keg fine, when you mail the rent check, if they push it and take the fee out fo your rent, go to local court house file small claims very easy paper work and go infront of a judge to get it resolve samll claims is realy no big deal quite simple and easy proccess |
