This is a legal research type question. I would like to know what
state law and case law (NY and NJ, in particular) has to say about
having a business which offered 'kissing services'. The idea is that
clients would be solicited who would be interested in having a kissing
partner and would pay for the service of being kissed (on the lips
only and no sex !). My intuition tells me that it might be legal as I
would assume that mouth to mouth kissing is not considered to be
sexual by most locales. On the other hand, a statute could be on the
books which outlaws 'pay kissing'. Is offering a 'pay kissing' service
legal ?

Dear cityguy-ga;

Thank you for allowing me an opportunity to answer your interesting
question. I?d like to remind you of our disclaimer that says, by
policy, we cannot provide legal advice in this forum. I can (and did)
however research your question by inputting the pertinent search terms
in to my best law and caselaw sources. In short, I found absolutely no
legal prohibition in either New York or New Jersey on a non-sexual
?kissing service? (kisser for hire, etc.) as long as the contact is
not lewd, lascivious, disorderly, and/or obscene or involves a minor
or other person who does not have physical or mental capacity to
consent to such activity. By comparison my research seems to indicate
that two consenting adults pressing their lips together in a
non-sexual way in both of these states is no more illegal than two
consenting adults pressing their hands together in a mutually
satisfying handshake. If someone wants to pay for that?well, to each
his own.

Take a look yourself. There?s no law or decision to be found in either
state that prohibits a kissing service.

If I may make a suggestion, I think it would be a good idea for you to
consult an attorney before acting on this idea of yours just to be
sure that you are acting with the law. At that time you may also
consider asking about issues surrounding civil liability for injuries
or illness that might be attributed to or alleged against your
business as a result of this type of physical contact and potential
exchange of breath and body fluids. Along those same lines another
topic of discussion might also involve issues surrounding liability
insurance and how you plan to protect, not only your clients, but also
your staff.

Hmmm. And, not to mention the potential civil liability if you passed
on some sort of <bug> by kissing. I suppose there is an implied
warranty . . .
