Can a court and sheriff 500 miles from me enforce a civil judgment?
The court commissionaire has already recalled a bench warrant stating
?plaintiff must follow the procedure for conducting an examination in
a court other then ours because defendant resides more then 150miles
away in another county?. Plaintiff then had the court use a writ of
execution to have the sheriff serve a levy on the local bank branch.
The bank levy dep. held and released the money to them in 10 days. The
rules seem clear, the court, the sheriff, the bank branch were the
account is maintained, and I most be in there jurisdiction to be
properly served. The rules say the sheriff must follow the rules. I
received the notice of levy from the bank to late to stop it. It
appears the bank and I were supposed to be personally served. I am
still fighting this because he set me up.
