This website may be of some help ... http://library.findlaw.com/1999/Oct/1/126857.html "Specifically, this section may apply to your question: Acquiring homestead rights in a piece of property in Texas does not require a formalized legal process, or the filing of a specific document. The general criteria for creating a homestead are (i) overt acts of usage, and (ii) an intent to claim the land as a permanent residence.(28)" If you intend to continue using your Toronto residence as your "permanent" residence, then I would assume that you would not qualify. I could be wrong, but I believe that the Federal laws regarding homsteading require you to be a citizen of the United States as well. Ill investigate that further. |

kanid-ga: Thank you. To be more specific: if a Canadian citizen lists Toronto as his residence on a business filing with the state but lives in Texas can he designate his Texas home as a homestead? |
