I am looking for the name of the firm or firms of attorneys who filed a class Class action suite against Robert Booth, MD in Philadelphia regarding improper use of Medcicare funding. Robert Booth claimed he did total knee replacements on orthopedic patients. He actually did not do the operations but he charged Medicare. These operations were done by his residents. He did not make appearance in operating room during operation. | |

According to Philadelphia Business Journal, Booth settled a Federal civil action, paying $1.9 million: http://philadelphia.bizjournals.com/philadelphia/stories/2001/09/10/weekinbiz.html The issue was fraudulent billing of Medicare, so it's not clear that there was ever a class action suit. |

Here's some more facts about the case with a link to request more documentation if you choose: http://medicine.iu.edu/~wecomply/newsltr/ Here's an article and press release by HMA: http://www.hma.com/Articles/010921.htm Again, I haven't found anything to indicate that it was a class action. None of the patients have appeared to file complaints, only medicare & the state. Also, since it was settled, attorneys are rarely mentioned. Good Luck, Rebekah |

To my knowledge, there are no class actions pending against Dr. Booth. Further, there was never an allegation that he "did not make and appearance in the operating room." Rather the US Attorney alleged that, because he did not supervise the entire procedure by the resident, he had violated Medicare billing regulations. |
