Hi folks, I live in Maine and am a Real Estate Broker. We have a home show we are producing to advertise houses and land we have listed in our area. It will broad cast on local access cable network. We needed musi for the background as this power point presentation plays. I chose songs with the word home or houses in them. We have 66 minutes of songs that we will be changing monthly. What will I need to do to play this burned cd as a background for our show? Sincerely, Karen Cudworth |

This is generally done through licensing societies. The largest two of which are the American Society of Composers, Artists and Publishers (ASCAP) and Broadcast Music Inc. (BMI). A smaller organization, the Society of European Stage Authors and Composers (SESAC) represents a few artists, primarily in the areas of classical, gospel and country music. In order to comply with the law, most hospitality operators will need to secure blanket licensing agreements with both ASCAP and BMI because each organization covers a separate slate of artists. There are three major licenses involved in your presentation; a performing rights license a synchronization license and a license for the use of the master in a video presentation. First the performing rights license. Your cable company probably pays both ASCAP and BMI for the rights to publicly perform music. That is usually a given and so you do not have to worry about that payment. When you put sound with video of any kind, it is said that you are "synchronizing" the music to the video presentation. This requires a "sync" license and they can be very difficult, (time consuming and expensive), to negotiate. Those negotiations are usually directly with the publisher. If you are using the orginal recording, there is the copyright in phonorecord to be considered and that would entail negotiating with a record company. So Karen, you see that this can be a big problem. Why not commission a local singer songwriter, or several of them to come up with some original music that you can buy outright and not have to worry about any licenses? You would also have a PR coup by using local talent on your show. All of their friends and relatives would talk up your presetations just to hype the music. I would think that you could commission 4 or 5 different singer songwriters to come up with some tunes about home or your local area and then you could choose from the best. Why not make it a contest in conjunction with the station. My point is there are many ways to use music that do not break the bank but still provide you with the "mood" that music can lend to your project and at the same time, promote your show and support local talent.
