Hello,

Four years ago a friend of mine was caught for stealing on the job.
However, can he still be charged for theft that many years later? If
so, what can he be charged with, and what consquence will happen in
court. I am asking you this because my friend was fired from the
job, but was able to quit instead. Recently he recived information
form the employer on what he stold. Is there any laws about being
charged for theft under $5000 years later. My friend lives in Canada,
Ontario.

Thank you
Scott

Greetings,
Please understand that this a free comment and not an "answer" to your
question, which only an official G-A Researcher with a blue name can
post.
Please also read the disclaimer below and understand that this is no
professional or legal advice.
This is just a layman's interpretation, having found a couple of sites
that seem to apply.

I hope they will help let a Researcher post an answer.

The Statute of Limitation (the period following an incident in which a
case can be presented) was six years. This was changed in 2004, but
it seems that the six year period still applies for anything that
happened before 2004.
This is discussed on this site:
http://www.greaterkwchamber.com/bright_ideas.shtml

The following site of a court case makes clear that the six year
period applied for thefts prior to 2004:
http://www.bcsc.bc.ca/comdoc.nsf/comdoc.nsf/webpolicies/97A0AFB3CDA65EE088256F9C00829268?OpenDocument

As mentioned above, this is no legal advice.

Since the employer apparently has not gone to court but only is now,
it seems, asking for payment for the stolen goods, it would be a good
idea for your friend to try to repay the fund the best way he can, by
installments perhaps, rather than anger the employer, who may then
find out that he can still charge him with the theft.

Has your friend admitted the theft? Did the company make a report?
Did your friend sign anything? Were the police involved? Did the
employer get the item(s) back ? Basically can your frinds former
employer PROVE that your friend actually stole? The best advise is to
have your friend talk to a lawyer.
