I am designing a game and I would like to include celebrity photos. 
Everything I have found says that if I profit from the likeness, I
need permission.

Having said that -- I see celebrity photos all the time in magazines,
etc.  Now we all know the paparazzi takes these photos without the
permission of the celebrity -- and the magazine profits from the photo
(as does the photographer.)

Here is my specific questions:

1.  Can I use a photo from a celebrity for something I will profit
from, such as a game, t-shirt, or lunchbox?  And if not, how do
magazines, etc have a loophole?

2.  Are there different rules for politicians versus celebrities, or
cartoons characters?

By the way -- these would not be controversial photos.  Just a head
shot -- a photo of the face.

Thank you for the link.  Very informative.  I just don't understand
how magazines can do it.  After all, if you eliminated photos from the
tabloids -- no one would buy them!  Thanks again!
