Are there any federal or state cases that involve where a spouse has
a living will and there is a confilct between her ex husband and new
husband making any medical decisons about her care? If there is can
you give me a case.

It would help to have more details.  Is there any document from the
woman giving a named person authority to make medical decisions on her
behalf?  (In some states, the living will simply gives instructions; a
separate health-care power of attorney or designation of health-care
representative may be used in some states to authorize an individual
to make medical decisions for an individual who is no longer capable
of making decisions for herself.)

Your questions makes it sound as if the woman created a document
authorizing Husband 1 to make decisions--but did not update her
paperwork after the divorce and marriage to Husband 2.  If this is the
case, let us know...  It could help to know whether the people and
paperwork are all in the same state--and even what state is involved.

Thank you for your quick response. : ) The state is Illinois. This is
kind of like the terri shavo case except of parents there are an ex
husband and new husband. As far as I know, her ex husband had a will
w/ her saying that he is power of attorney but they divorced a year
latter she remarried and set up a new living will that may have her
new husband an power of attorney. All i would need is a case either
federal or state ex terri shavo Vs. ??// Thank you for all your help!
