Question ID: 712969
I have an idea for a toy/souvenir that I would like to market to
professional sports teams and universities. This product would be
sold at souvenir stands and would have the team or school logo printed
on it. I have two questions regarding this:

1) Am I legally able to manufacture and sell products that have a
copyrighted logo on them? My intent is to sell them directly to teams
and/or schools, not directly to consumers. What issues do I need to
be aware of when manufacturing and selling items with copyrighted
logos?

2) I have looked online for a company that can manufacture this item
for me but have had limited success. Without giving away too much,
the item is primarily comprised of plastic, would need to have logos
printed on it and is rather simple in design. Where can I find a
company to prototype and manufacture something like this? I live in
the San Francisco bay area and would prefer a local company though it
isn't necessary for it to be nearby. Price and competency are more
important to me than location.

Thanks in advance!

Hi!

First of all I think you won't have any problem with this as long as
you do the following first.

a.) Ask for licensing of the school's name and logo.

b.) Don't manufacture anything yet until you get the license. Since
you will directly sell to the schools anyway, seek their approval
first so you won't have wasted merchandise and costly litigation.
