Dear kpresearcher-ga;

Thank you for allowing me to answer your interesting question. It
seems this restriction is not necessarily a matter of law; so much as
it has become a special mandate in certain areas. The precedent for
this restriction originated in Los Angeles by way of SPECIAL ORDER 40
(1979) and similar directive have since been adopted in many other
regions of the country that have considerable immigrant (both legal
and otherwise) populations:

FULL TEXT OF SPECIAL ORDER 40
http://keepstuff.homestead.com/Spec40orig.html

Special Order 40 is not a law that can be challenged through the
courts ? in fact, it is not a law at all. LAPD?s ?Special Orders? can
only be created, amended or repealed by the Chief of Police and as
such this is a matter of policy, not law.

?What is Special Order 40? Daryl Gates, LA police chief in 1979,
bowing to illegal alien immigrant advocates? growing power, introduced
the order. Much like Lord Chamberlain?s bowing to Hitler to preserve
the peace for a ?moment? in history, the order prohibited officers
from ??initiating police action where the objective is to discover the
alien status of the person.?

As illegal alien migration grew, so did its powerful advocates. The
order was adopted by cities across America. Today, illegal alien
criminals are free to move about the country in San Francisco,
Chicago, Atlanta, New York, Denver, Phoenix, Miami, Detroit, Houston,
Dallas and most other cities across the United States.?

The following is an extensive list of other law enforcement
organizations and jurisdictions that are also said to have expressed
opposition to the idea of having state and local police enforce
federal immigration laws, beyond the limited avenues already available
under current law (which is essentially the crux of Special Order 40).
Their positions are reportedly reflected in a variety of
organizational policy directives, statements made to the press, local
resolutions, executive orders, or statements in other public venues
similar to the provisions set forth by Special Order 40:
