IN NY, Under CPLR 306-(b)don't i have to be served within 120 days of
the filing for an index number for a lawsuit?  I was said to have been
served on Feb 1, 2006 which I wasn't, I was never served any summons
of any kind.  The date of the filing for the lawsuit was August 24,
2004.  I live in NY and the action is taking place in NY.  The time
between when they say I was served and the date of filing is 1 year
and 161 days.  Also, like I said, the first I learned of this lawsuit,
was just this weekend when I received a motion for judicial
intervention.  Any Ideas anyone?

Go to court and tell the judge that.
