I bought a wedding dress from a Ebay Store called BuyDirectBridals.
The dress cost $1100. The dress was a Lady Roi dress, Style # 8569. I
measured myself and sent the measurements to the seller, asking which
size would be best to order. She wrote back and told me a size 12. I
looked on the chart and all the measurements for the size seemed to
correspond with my figure.
I should also mention I have worked in the costume construction field
for three years. I studied sewing. I know how to take measurements,
they were not inaccurate.
The dress (you can still find it on Ebay) has a photo that indicates
an "A-line" skirt. The dress flares out from the waist. It does not
cling to the body at all. The photo shows a perfect "A" formation
(hence the name).
I received the dress two days ago. I measured myself and I am the same
measurements as before. I tried on the dress and could barely fit it
over my hips. I could not bend over it was that bad. The dress clung
to me down to above the knee, where THEN it flared out.
This is obviously not what the picture showed. I have photos of my
dress to prove it.
I complained to the seller and asked for a Refund. She said that
because the gown was special ordered, there are no refunds. She even
stated this in the add on Ebay.
The dress took 4 months to complete and I am no longer (according to
the rules of Ebay) able to file a complaint.
My Question is:
Do I have the right to get a refund? Is this seller legally bound to
give me a refund? (the amount was $1100). |
