I need Zyrtec for my allergies, but I don't have any health insurance
at the moment.  I found a website called xlpharmacies.com.  It seems I
can order Zyrtec through them for a total of $47.42 after s&h.  That
will get me a 2 month supply (60 pills).  Is this legal?  I live
outside of Philadelphia, PA, and that's where the pills will be
shipped.  Why do I not need a perscription?  Is xlpharmacies.com a
safe website to use, for both its drugs and my credit card?

IMPORTING MEDICATIONS

Much of the reference material online refers specifically to importing
medications from Canada so I used this in my search terms. The
information regarding its legality is applicable to any foreign
country.

The Food and Drug Administration has a publicly posted letter
regarding importing medications from Canada. In it they say,

?From a legal standpoint, businesses and individuals that are involved
in shipping prescription drugs to consumers in the U.S. must take many
steps to ensure compliance with the Federal Food, Drug, and Cosmetic
Act. Practically speaking, it is extremely unlikely that a pharmacy
could ensure that all of the applicable legal requirements are met.?

Some of the reasons that it is ?extremely unlikely? that these
requirements will be met are listed in the same letter.

?Even if a prescription drug is approved in the U.S., if the drug is
also originally manufactured in the U.S., it is a violation of the Act
for anyone other than the U.S. manufacturer to import the drug into
the United States. . . .  Generally, such drugs are unapproved, . . .
labeled incorrectly, . . . and/or dispensed without a valid
prescription. . . . Thus, their shipment into the U.S. from Canada
violates the Act.

?The reason that Canadian or other foreign versions of U.S.-approved
drugs are generally considered unapproved in the U.S. is that FDA
approvals are manufacturer-specific, product-specific, and include
many requirements relating to the product, such as manufacturing
location, formulation, source and specifications of active
ingredients, processing methods, manufacturing controls,
container/closure system, and appearance.  Frequently, drugs sold
outside of the U.S. are not manufactured by a firm that has FDA
approval for that drug.  Moreover, even if the manufacturer has FDA
approval for a drug, the version produced for foreign markets usually
does not meet all of the requirements of the U.S. approval, and thus
it is considered to be unapproved.?

Finally, the FDA speaks of its right to prosecute individuals who violate this act.

?This policy is not intended to allow importation of foreign versions
of drugs that are approved in the U.S., particularly when the foreign
versions of such drugs are being ?commercialized? to U.S. citizens. .
. . Although we must concede that FDA has not often prosecuted those
importing illegal drugs into the United States from Canada, FDA
reserves the right to do so in the appropriate circumstance.?

In summary, it his highly unlikely that XLPharmacy is in compliance
with these regulations. In that case, importation would most likely be
illegal and subject to prosecution, although the FDA admits that legal
action is unlikely.

location for Xlpharmacies was equally difficult. Again, in their FAQs,

Asking about whether or not their products are brand name drugs,

The company uses SSL encryption for its credit card transactions, and
claims to prevent ?unauthorized access? of personal information.


Searching for www.xlpharmacy.com on Whois.com reveals that it is a
privately registered website through Internet Technologies Group, Inc.
(www.itg.com), a web design and development company. The original
publication date for the XLPharmacy site is April 13, 2004, and its
country of origin appears to be Seychelles, an Indian Ocean Island
nation formerly under British rule. There is contact information for
the company itself located on the Whois site.

Personally, I have bought many pharms online.  I currently use
xlpharmacies.com (as you mentioned) and I have never had a problem.  I
have used many other companies and XLPharmacies.com is by far the best
out there that I have tried.  They actually bought out the most
popular online pharmacy and now they are themselves one of the
biggest, if not the biggest.

As stated in the answer above, the FDA will most likely never
prosecute anyone for buying pharms online from overseas.

That said, I can tell you that if you try to order Viagra, especially
generic Viagra overseas, your order will be stopped by customs, sent
back to sender, and you will receive a letter from the US
Customers/Dept of Homeland security telling you that it is illegal to
import generic Viagra because Pfizer has a lobby group in the US
government that allows them to prohibit anyone to make, buy, and sell
any generic versions of Viagra.

Also, keep in mind that you will likely get into some trouble if you
are ordering psycho drugs (like Paxil and Prozac) as well as pain
killers and other such drugs that are very popular street drugs.

But if you are buying all other drugs, your chances of ever
experiencing any negative legal problems form it are very slim at this
point.

However, it is a good idea to make sure you listen to the news on a
continual basis in order to keep on the up and up with things like
this.

Also realize that when you buy drugs online from other countries, you
are on your own and you will have very little legal recourse if you
should ever need to take any legal action yourself.

Proceed with caution but do what you have to do in order to stay alive
and/or live a better life free from ailments.  Don't let the
governments, lobbyists, and politicians decide what's right for you. 
They know not what they do.  They are merely extortionists, liars and
thieves (and that isn't really an opinion if you know anything about
these things).  I save $650-$700 on pharms every month by buying
online from overseas companies.  That's all that matters to me.  If it
were not for these pharmacies, I would be very poor and/or dead.

I just ordered from XLPharmacy.com some acne creams that would cost me
a fortune here in the states and the delivery was very fast.  Just to
visit a dermatologist you can expect to pay $75 a visit and Retin A
usually runs over $100.  I've ordered form them before and the quality
is very good.
