Myself and a roommate moved into an apartment Friday, the lease
started Saturday. There are roaches everywhere. I kill maybe 10 a day
but I just saw yesterday that there were a bunch in the kitchen that
scattered when the lights came on.

Honestly, we would rather just move out then deal with this. It is in
day 4 of the lease now and we are in San Jose, CA. We did not see any
roaches when we inspected the apartment, only the night we moved in.

Is there a way we can break the lease within the first week or month,
on the grounds of being infested/inhabitable? We have told the
landlord and he has only provided another can of roach spray. We are
on the second can of roach spray.

I had a similar problem many, many years ago.

I called my local Dept. of Health and they came to inspect the
deplorable conditions.

They sent a letter to the landlord stating that, due to health
reasons, I was to vacate the premises immediately with no legal
obligations to my lease.

I moved and heard nothing back from the landlord.

I just asked and he let us out of the lease.
