This is not homework. I am an attorney. I need a case to support my motion for summary judgment on behalf of my client/plaintiff. standing for the propisition"Danger invites rescue" as close to the following fact pattern as fo0llows. Must be New York. Court of appeals preferred or second department.My client/plaintiff is a security guard at a construction jobsite. He observes defendant/driver backing his mack truck onto the public sidewalk about to strike a lampost. He runs to waive off driver and is struck by the falling lampost. Defendant will claim that a jury could find plaintiff comparatively negligent and thus s/j should not be grante. We say it should since defendant can not have the benefit of a danger which he created. Find case as close as possible |

Umm.. you are an ATTORNEY that gets paid to do just THAT.. research, research,research and more research to convince the judge/panel/jury your client is righteous.. Do your own job! |
